doivent avoir au moms le diplome de maitrise de management, de comptabilite, d'assurance, des affaires financieres, de 11 economie, de l' informatique et cinq ans d'experience professionnelle. L' organisation nationale de gestion et de planification doit confinner les conditions requises pour ces postes.

Remarque 2 — Toutes les responsabilites et les prerogatives des organes administratifs — etatiques et publics — des fonds et des organisations actives dans les domaines d' assurance, de protection et de secours, ainsi que des ministres seront transferees au ministre du Bien-etre et de la Securite sociale. Ce transfert comprend egalement l' adhesion et/ou la presidence des conseils, des associations et des conseils administratifs des dits organes, des commissions et des sous-commissions du gouvemement, des conseils superieurs concernes, ainsi que les associations et organisations intemationales.

Article 18— L' application de cette loi pour le comite d'aides et de secours de l'Itnam Kbomeyni, que sa demeure soft au paradis, et les forces annees dependra de l'autorisation du Guide supreme de la Revolution islamique.

Article 19— Depuis la ratification de cette loi, toutes lois ou parties de loi portant sur les affaires relatives aux assurances sociales et medicales, ainsi que les affaires relatives a la protection et au secours, en contradiction ou opposition avec cette loi seront abrogees.

Cette loi, en 19 articles et 21 remarques, a ete radii& lors de la séance publique de l'Assemblee islarnique d'Iran, le 12 mai 2004, et approuvee, le 29 mai 2004, par le Conseil des gardiens de la Constitution iranienne.

Conseil des ministres. 2- Les autres membres seront choisis en proportion des individus

converts les services, selon les reglements approuves par le Conseil des ministres. Au cas on ii n' y aurait pas d' usagers et/ou de groupes usagers organises ou syndiques, ces membres seront choisis avec la proposition du ministre du Bien-etre et de la Securite sociale, et l' approbation du Conseil superieur du bien-etre et de la securito sociale ainsi que du Conseil des ministres.

Remarque — Au cas oü ii s'avererait necessaire d' avoir un fonds d'assurance special pour le personnel d'un ou de plusieurs organes administratifs, deux personnes seront choisies par le plus haut responsable de l'organe conceme pour participer aux reunions du Conseil ou de l' assemblee d'administration en tant qu'observateurs.

b) Conseil adtninistratif : comprend 5 ou 7 membres ayant l' expertise et l'experience necessaire qui seront choisis pour un mandat de quatre ans par le conseil ou assemblee d' administration (sans avoir aucune responsabilite administrative). Leur reelection est autorisee et ils peuvent choisir l'un d' entre eux comme President du Conseil administrant'.

c) President directeur general: est une personne en dehors de assemblee ou du conseil d' administration, proposee par le conseil

administratif pour un mandat de quatre ans. Sa reelection est autorisee

d) Conseil de surveillance: comprend trois membres ayant l' expertise et l' experience necessaire choisis par le conseil ou l'assemblee d' administration pour un mandat de qualm ans. Leur reelection est autorisoe. La cour des comptes assume les responsabilites de l'inspecteur legal, et elk doit remettre ses rapports au conseil de surveillance.

I) Preparation du terrain au developpement de la presence et de la participation des organes caritatifs et civiques dans les secteurs de protection et de secours dans le systeme global de la securite sociale.

m) Creation des sites d'informations du systeme global de la securite sociale afin de collecter et traiter les informations pour determiner les criteres differents dans les domaines d'assurance, de protection et de secours.

n) Application des recherches appliquees. Remarque — L' organisation des commissions specialisees et

strategiques necessaires dans les trois domaines differents du systeme global de la securite sociale sera soumise aux reglements qui seront approuves par le Conseil des ministres.

Article 17 — It tninistere du Bien-etre et de la Securite sociale dolt, 30 jours au maximum apres la ratification de cette loi, verifier et corriger les statuts de tous les organes adruinistratifs, des fonds et des institutions etatiques et publiques actives dans domaines d' assurance, de protection et de secours (dans le cadre du plan global d' aides et de secours) et les autres organes concernes par cette loi. Cette verification et correction doivent etre approuvees par le Conseil des ministres apres l'approbation du Conseil superieur du bien-etre et de la securite sociale. La correction doit s'appliquer de maniere a ce que les institutions concemees se conforment au modele suivant:

a) Conseil ou assemblee d' administration sous les conditions suivantes:

1- La moitio plus un des membres sera choisi, avec la proposition du ministre du Bien-etre et de la Securite sociale, avec la ratification du Conseil superieur du bien-etre et de la securite sociale et du

e) Elaboration de l'avant-texte des projets de loi, des reglements et des directives necessaires pour realiser les objectifs et les principes des politiques du systeme global de la securite sociale, avant les proposer aux organes concernes pour l' approbation.

f) Elaboration generale du budget public du gouvernement dans les domaines d' assurance sociale, d' assurance des services medicaux, de protection et de secours, avant les proposer au Conseil superieur du bien-etre et de la securite sociale.

g) Gestion des ressources et des dopenses, elaboration du budget du systeme global de la securite sociale pour equilibrer les credits et ressources consacres aux differents domaines de la securite sociale.

h) Organisation d'un systeme de controle et d'evaluation des activites du systeme global de la securite sociale, et elaboration des rapports a remettre au Conseil superieur du bien-etre et de la securite sociale.

i) Organisation et gestion administrative du systeme des subventions sociales pour les diriger vers les individus et les foyers besogneux en favorisant le processus de leur independance financiere et professionnelle dans le cadre des lois et des politiques generales de l'Etat.

j) Elaboration et organisation des mecanismes du systeme global de la securite sociale de sorte que tous les usagers, notanunent les individus besogneux regoivent les services de la securite sociale par les reseaux d' assurance.

k) Verification et evaluation permanente pour s' assurer de la stabilite de la situation financiere (ressources et depenses) dans les domaines relatifs de la securite sociale afin d' appliquer les engagements actuels et futurs, avant de remettre les rapports necessaires aux organes concernes.

e) Proposition des reglements generaux de la direction des fonds, des reserves et des investissements des organes administratifs (etatiques et/ou publics) des organisations, des institutions et des fonds actifs dans les differents domaines de la securite sociale, avec Papprobation du Conseil des ministres.

Remarque — Les reglements des seances, du vote et les autres affaires relatives au Conseil superieur du bien-etre et de la securite sociale seront elabores par le rninistere du Bien-etre et de la Securite sociale, et approuves par le Conseil des ministres.

Article 16 — Pour realiser les objectifs et appliquer des responsabilites indiquees dans le Chapitre premier, et les politiques indiquees dans le Chapitre II de cette loi, les prerogatives et les responsabilites du ministere du Bien-etre et de la Securite sociale

sont les suivantes: a) Preparation du terrain pour la concretisation des principes de

generalite, de couverture, et de globalite des services d' assurance, de protection et de secours dans le pays (dans le cadre du plan global d' aides et de secours).

b) Coordination et interaction des programmes generaux de la securite sociale avec les plans globaux dans les domaines d' emplois, de santes et de services medicaux, d' education nationale et de logement, ainsi que les autres domaines concernes.

c) Elaboration des politiques, des strategies et des criteres de globalite, ainsi que efficacite du systeme global du bien-etre et de la securite sociale, conformement aux lois et aux politiques generates de l'Etat avant obtenir l'approbation du Conseil superieur et du Conseil des ministres.

d) Coordination des projets administratifs dans les trois domaines du systeme global de la securite sociale.

Article 14 — La composition du Conseil superieur du bine-etre et de la securite sociale est la suivante:

a) President de la republique (president du conseil) b) Ministre du Bien-etre et de la securite sociale (Secretaire du

conseil) c) President de l'Organisation des planifications nationales d) Ministre de l'Interieur e) Ministre de la Sante f) Ministre de l'Education nationale g) Ministre du Logement et de l'Urbanisme h) Ministre du Travail et des Affaires sociales i) Ministre de la Defense j) Ministre de PEconornie et des Finances k) Trois deputes de l'Assemblee islamique, etant membre,

chacun, de la commission de la sante et des services medicaux et sociaux, de la commission des programmations, et de la commission de la Cour des Comptes, choisis par!' Assemblee islamique en tant qu'observateurs au conseil.

Article 15 — Les responsabilites du Conseil superieur du bien-etre et de la securite sociale sont les suivantes:

a) Coordination des politiques sociales. b) Interaction avec le Conseil de l'economie et les autres conseils

pour resoudre les problemes sociaux. c) Verification, correction et approbation des politiques du bien-

etre et de la securite sociale, avant de les proposer au Conseil des ministres, selon les politiques generales de l'Etat.

d) Verification, correction et approbation du budget annuel du bien-etre et de la securite sociale dans le cadre des politiques budgetaires communes avant les proposer au Conseil des ministres.

I' assurance, la nomination de « fonds n, doit 'etre choisie pour toutes les organisations et les organes actifs dans les domaines d' assurance sociale et medicale.

Remarque 3 — SeIon les statuts du 7 fevrier 2003 du Guide supreme de la Revolution islamique au President de la Republique, tous les organes qui convent avec leurs services les families des martyrs, des prisonniers de guerres, les portes disparus et les mutiles de la Revolution islamique et de la guerre imposee par l'Irak A la Republique islamique d'Iran doivent se fusionner en un seul organe. Au cas de l' approbation du Guide supreme de la Revolution islamique, tous les biens, les avoirs et les proprietes de la Fondation des martyrs de la revolution islamique, de l'Etat-major des affaires des prisonniers de guerre liberes et 50% des biens, des avoirs et des proprietes de la Fondation des deshorites et des invalides doivent etre Uansfores a cet orgarie unique. Les fonds obtenus par des biens et des proprietes precites doivent etre utilises uniquement pour les affaires des families des martyrs, dans le cadre du systeme global de la socurite sociale.

Article 13 — Le Conseil superieur du bien-etre et de la securite sociale : ce conseil est cree pour coordonner les politiques sociales dans les domaines de la securite sociale, de l'emploi, de l' education nationale, de l'oducation physique, du logement, de la sante, des services medicaux et des autres domaines relatifs A la securito sociale. Ce conseil est preside par le President de la Republique, et le ministre du Bien-etre et de la securite sociale est le secretaire de ce conseil. Le secretariat du conseil sera etabli au ministere du Bien-etre et de la Securite sociale, et les decisions prises par ce conseil auront la force executoire apres la ratification par les membres et l' approbation du president de la Republique.

Article 12 — Les quatre piliers du systeme global de la securite sociale sont les suivants:

1- Conseil superieur du bien-etre et de la securite sociale 2- Ministere du Bien-etre et de la Securite sociale 3- Institutions, organisations et fonds principaux dans les

domaines d' assurance sociale, assurance de services medicaux, de protection et de secours, charges d'organiser et de diriger ces fonds, y compris les fonds publics et les subventions consacrees par les ministeres ainsi que les fonds obtenus par la cooperation des partenaires sociaux charges par le gouvemement des affaires administratives dans les domaines d'assurance sociale, de services medicaux, de protection et de secours.

4- Institues administratives: comprenant les compagnes d' assurance coimnerciale, les mairies, les prefectures et les autres structures administratives sous formes de banques, de fonds financiers, de compagnes de services et les organes caritatifs et civiques qui sont actifs dans le cadre du systeme global de la securite sociale en vertu des accords et des notes d'entente conclus.

Remarque 1 — Les institutions, les organisations, les institues et les fonds principaux actifs dans les domaines d' assurance, de protection et de secours doivent confer les affaires administratives concernant leurs services et leurs engagements legaux, dans le cadre de leurs contrats, dont les reglements sont proposes par le ministere et approuves par le Conseil superieur du bien-etre et de la securite sociale, aux instituts administratives precises.

CHAPITRE III

Organisation

Article 11 — Pour concretiser la mise en vigueur le systeme global de la securite sociale et favoriser son application, le Ministere du Bien-etre et de la Securite sociale sera cree.

Remarque 1 — II est interdit d' utiliser les ressources du systeme global de la securite sociale, soit les ressources publiques, soit les subventions d' assurance, de protection et de secours destinees aux organes administratifs du gouvernement ou des fonds et des organisations non gouvemementales, en dehors du systeme global de la securite sociale. L'utilisation de ces ressources necessite l'acceptation de la supervision et de la direction strategique du Ministere du Bien-etre et de la Securite sociale.

Remarque 2 — Les directives approuvees par le Ministere de la Sante concemant les affaires hygieniques et medicales, ainsi que la categorisation des services medicaux et le mecanisme du transfert de ces directives au Ministere du Bien-etre et de la Securite sociale sont dotees d'une pouvoir executif.

sont limitees dans les trois aspects pitches (suffisance, globalite et couverture), le gouvernement doit observer une politique progressive pour developper ses capacites dans ce domaine, dans le cadre des programmes de developpement national.

Principes et politiques subventionnelles

Article 10— L' adoption des politiques subventionnelles s' effectue dans le cadre des lois et selon les politiques generales du pays pour reorganiser les aides subventionnelles, en utifisant les possibilites offertes par les systemes d' informations a l'ochelle nationale tels que le plan du code national et du systeme fiscal. II convient de recluire, voire annuler les aides subventionnelles aux foyers plus riches pour augmenter la part des foyers moths favorises de ces aides. Les ressources obtenues par la reduction ou l'annulation des aides subventionnelles aux foyers plus riches seront destinees fournir une partie des ressources necessaires dans le systime global de la securite sociale.

la necessite de la coordination avec les autres organes concernes, de sorte que les efforts destines A prevenir des derives et des problemes sociaux soient observes cormne une politique coherente et generale.

e) Politique de renforcement: ii s'agit de reduire l'usage des mothodes necessitant le foumissement direct des besoins, pour augmenter les capacites individuelles et collectives des usagers pour fournir eux-memes leurs besoins.

f) Politique de creation d'emplois: c'est un mecanisme non protectionniste pour favoriser la creation d' emplois, et le fournissement des services de bien-etre social sous condition du respect des engagements de la part des individus.

g) Politique active d'identification des besogneux: H faut respecter les droits des individus en se servant des systemes appropries de statistiques et d'informations pour respecter la dignite humaine des besogneux et eviler les methodes meprisantes.

h) Le gouvemement dolt garantir le respect des droits des usagers A regard des engagements legaux des organisations, des institues et des fonds d'assurance dans le cadre du systeme global de la securite sociale. Le gouvernement doit prendre les mesures qui s'imposent sur les plans de finances, de credits et de structuration, dans ce domaine.

i) Les fonds d' assurance doivent donner des engagements legaux leurs usagers en respectant les principes de la justice, en proportion

du niveau de leur participation (le precedent et le taux du paiement) pour organiser r entree et la sortie de leur caisse.

j) Les organisations, les institues et les fonds d'assurance du systeme global de la securite sociale ont leurs engagements, et les assures peuvent leur demander de leur fournir leurs engagements.

e) Les debits des organisations, les fonds et les institutes d'assurance, actifs dans les domaines differents du systeme global de la securite sociale doivent etre payes par le gouvemement selon leur valeur actuelle et le taux des titres de la participation.

Principes et politiques economiques

Article 8— Pour reduire les consequences negatives des politiques et les plans economiques de developpement sur le bien-ethe et la securite sociale des citoyens, et pour empecher toute sorte de chocs due a. l' application des dites politiques, le responsable du systeme global de la securite sociale notamment dans les prises de decision economique, doit participer, ay ant le droit de vote, dans les negociations portant sur la determination des salaires minimum, dans le Conseil economique, le Conseil superieur d'emplois, le Conseil superieur de travail, le Conseil de monnaie et de credits, le Conseil superieur del' assurance des services medicaux, le Conseil superieur de la sante et le Conseil superieur de la famine.

Article 9 — Les principes et les politiques administratives du systeme global de la securite social sont les suivants:

a) Politique de globalite: il s'agit de fount tous les services varies mentionnes dans cette loi.

b) Politique de suffisance: selon laquelle, ii faut rehausser, d'abord, le niveau minimum des besoins essentiels de tous les citoyens, ensuite, de la quake' et de la quaritite des services fourths.

c) Politique de couverture: les services du systeme global de la securite social doivent couvrir tous les citoyens.

d) Politique de prevention: doit etre appliquee dans les trois domaines d' assurance, de protection et de secours, en insistant sur

domaines du systeme global de la securite sociale avec l'autorisation du Guide supreme de la revolution islamique.

11- Les revenus obtenus par les investissements et les ressources et des reserves financieres des organes administratifs, etatiques et non etatiques, des organisations et des fonds actifs dans les differents domaines du systeme global de la securite sociale.

Remarque — la prise des mesures necessaires dans les domaines de finances, de credits et de structuration afin de garantir la constance des services d'assurance et de protection et de secours aux citoyens darts le cadre du systeme global de la securite sociale.

b) Supervision financiere des ressources: Tous les organes, les organisations, les institutes et les fonds

actifs dans les domaines relatifs A l'assurance, A la protection et au secours sont soumis A la supervision du gouvemement dans le cadre de cette loi en ce qui conceme l' usage de fonds et de ressources du systeme global de la socurite sociale.

c) L' application des decisions et des decrets du gouvemement pour reduire les ressources ou augmenter les frais ou les engagements des fonds et des institues d'assurance dependent du fournissement des ressources financieres oquivalentes a ces reductions et augmentations. L' annulation des reglements de cette clause doit s'effectuer A condition de mentionner le nom et le sujet dans les autres lois.

d) Les sornmes, les biens, les reserves et les avoirs des fonds d'assurance sociale et medicale equivalent aux biens publics, leur propriete est par indivis et appartient a toutes les generations de la societe couverte par les services de la securite sociale. Le gouvernement ne petit s' emparer de ces biens ou etablir des relations fmancieres avec les dits fonds que dans le cadre des lois et des reglements concemant les activites de ces fonds.

l' assurance doivent etre une personne morale, financierement et administrativement autonome, et us doivent se soumettre aux reglements du systeme global de la securite sociale.

Article 7— Les politiques et les principes financiers du systeme global de la securite sociale sont les suivants:

a) Constance des ressources financieres: 1- Usage des ressources publiques. 2- Sources obtenues de la reorganisation des subventions. 3- Equilibre entre les ressources et les frais des fonds

d' assurances, tout en conservant la personne morale et l'autonomie financiere de ces fonds.

4- Participation des employeurs, des assures et du gouvemement pour assurer une partie des ressources nocessaires dan le secteur de l' assurance.

5- Les ressources destinees A compenser les dommages dus l' application des politiques economiques de developpement.

6- Usage des ressources obtenues des aides populaires dans des differents domaines du systeme global de la securite sociale.

7- Usage des ressources obtenues des biens !agues en faveur des ceuvres de bienfaisance dans les domaines relatifs au systeme global de la securite sociale.

8- Usage des ressources obtenues des taxes religieuses dont le taxe du cinquieme du revenu superflu et la zakat, dans les domaines relatifs au systeme global de la securite sociale, avec l'autorisation des sources d'inspiration (hauts dignitaires religieux).

9- Usage des ressources obtenues des charitos, dans le cadre des domaines relatifs au systeme global de la securite sociale.

10- Usage des ressources et des biens appartenant aux organes et aux fondations de la Revolution islamique dans les differents

supervision doit s'effectuer selon le contenu de cette loi et les criteres inscrits dans les reglements, les contrats et les accords des services de securite sociale.

i) Competitivite: II faut favoriser la competitivite dans les affaires administratives du systeme global de la securite sociale pour atteindre les objectifs suivants:

1- La possibilite de la competitivite doit etre garantie dans tous les niveaux de la securite sociale.

2- Les assures doivent pouvoir choisir leur assurant prefere. 3- SeIon les lois, le gouveinement a le droit de controler les

affaires relatives A la securite sociale pour empecher tout monopole dans ce domaine, en s' assurant qu'un vrai climat de competitivite y existe.

j) les modalites de la participation financiere : 1- tine part egale sera consacree aux fonds actifs dans tous les

niveaux des assurances publiques et medicates pour chaque membre, a partir des ressources publiques pour chaque habitant; cela n'empechera pas le soutien du gouvemement aux couches defavorisees de la societe.

2- Le pourcentage de la participation et la part payee par l'employeur seront consacres en parts egales aux fonds actifs dans tous les niveaux des assurances publiques et medicates.

3- Le pourcentage et la part payee par!' assure seront consacres en parts egales aux fonds actifs dans tous les niveaux des assurances publiques et medicates.

k) Les modalites du transfert : Le transfert individuel et/ou collectif des assures d'un fonds d'assurance publique a un autre sera autorise, conformement aux statuts approuves par le Conseil des ministres.

des reglements determines. Cette participation comprend egalement la participation des usagers et/ou des groupes d'usagers organises ou syndiques conune les organisations non gouvemementales. Cependant, cette participation n' enleve pas la responsabilite du gouvemement en ce qui conceme la securite sociale.

e) Les aides populaires de la part des institutions et des organisations non gouvemementales sont admises, a condition qu'elles soient conformes aux reglements du Conseil des ministres et qu'elles soient verifiables par le systeme de la securite sociale.

f) Amelioration de la qualite des services selon les trois politiques suivantes :

- Specialisation des activites d'apres le type des services. - Specialisation des activites d'apres le type des usagers. - Specialisation des activites d' apres le niveau des services

(publiques ou complementaire). g) Centralisation et decentralisation: 1- Les programmations, la supervision, r evaluation et la

distribution des ressources publiques doivent etre assurees par le gouvemement d'apres un modele de centralisation.

2- Les affaires administratives doivent s'effectuer selon un modele de decentralisation.

3- Les interventions du gouvernement dans les affaires administratives de la tante sociale s' effectuent lorsque les activitas des organisations non gouvemementales s'avereraient insuffisantes ou bisque ces interventions seraient necessaires pour reglementer le 'naiad des services dans le domaine de la securite sociale.

4- D faut egalement faire observer les conditions regionales dans les programmations.

CHAPITRE II

Principes et politiques generales

Article 6— Les principes et les politiques structurelles du systeme global de la securite sociale sont les suivantes

a) Concertation dans chaque domaine : l'organisation et la coordination dans les activitos et les services fournis dans chacun des domaines d'assurance, de protection et de secours, afin d'augmenter l'efficacite et la couverture de ces activites pour eviter toute interference.

b) Concertation entre les domaines differents : la coordination entre les domaines d'assurance, de protection et de secours, en reservant le role axial pour le systeme d'assurance.

c) Concertation entre les plans de prevention et les plans administratifs dans les autres secteurs impliques dans la securite sociale.

d) Participation du secteur non etatique : le systeme de la securite sociale se fonde sur le principe de la participation dans le mecanistne de prise de decision, la programmation, l'application et l'evaluation, de sorte que les institutions et les organisations non gouvemementales puissent participer a cette tkhe, dans le cadre

Remarque — L'Association du Croissant rouge de la Republique islamique d'Iran est une organisation non gouvernementale dont les statuts ont ete ratifies par l'Assemblee islatnique d'Iran.

f) Paiement de pensions aux chercheurs d'emploi sous forme de prat

g) Couverture assurance pour les foyers delaisses et les femmes chef de foyer.

h) Creation des moyens necessaires permettant la rehabilitation et la formation professionnelle des foyers besogneux.

i) Protection des metes surtout pendant la grossesse et la garde des enfants.

j) Services necessaires pour =0:cher ou reduire les infirmites et les traumatismes sociaux, et couverture assurance dans les trois domaines de la prevention, du traitement et de la rehabilitation.

k) Creation des moyens necessaires permettant l' amelioration de la situation physique, morale, sociale et economique des invalides et des individus defavorises ou marginalises pour assurer leur autonomie.

1) Preparation d'un milieu social et physique favorable aux activites sociales des invalides.

m) Poursuite du processus de protection des besogneux dans les villages et dans les tribus nomades.

Article 5 — Les objectifs et les responsabilites du secours sont les suivants:

a) Preparation et concertation entre les organisations et les organes concern& pour fournir les services suffisants et rapides aux sinistres des evenements imprevus pour assurer les besoins d'urgence des sinistres des fleaux naturels dont la nourriture, l'habit et les logements provisoires, dans le cadre du plan national d' aides et de secours.

b) Prevision des mecanismes nocessaires pour la reconstruction des regions sinistrees A court terme, en cooperation avec les

j) Developpement des informations concernant les services d'assurance.

Remarque 1 — Les fonds d'assurance peuvent developper leurs activites dans le domaine de l'assurance sociale et/ou l'assurance medicale.

Remarque 2 — Le gouvernement doit, en deux ans apres la ratification de cette loi, assurer la couverture assurance pour toutes les couches de la societe dont les habitants des villages, les intennittents, et les tribus nomades.

Remarque 3 — Les engagements des organisations et des fonds d'assurance, anterieurs a cette loi, vis-a-vis des assures, restent valables, a condition que les assures soient lies uniquement a une organisation ou compagnie d' assurance. Les excedents doivent etre fournis par cc systeme global.

Article 4 — Les objectifs et les responsabilites de la protection et de la rehabilitation sont les suivants:

a) Organisation du systerne des subventions et les ressources protectionnistes.

b) Concertation des divers secteurs etatiques pour empecher les traumatismes sociaux.

c) Participation a la determination du seuil de la pauvrete (absolu et relatif).

d) Protection des citoyens face aux evenements economiques et sociaux ainsi que leurs consequences negatives notamment le chemage, le delaissement, la &route et la vieillesse.

e) Garantie du niveau de vie minimum pour tous les individus et les foyers besogneux, ayant les revenus insuffisants, donnant la priorite aux individus incapables, physiquement et moralement, de travailler.

et de rehabilitation, ainsi que de l'octroi de subvention et des aides financieres aux individus ou aux foyers besogneux qui ne sont pas capables, pour diverses raisons, de travailler ou leurs revenus sont insuffisants pour assurer le niveau de vie minimum.

C) Secours: H s'agit des operations de secours lors des incidents imprevus.

Article 3 — Les objectifs et les responsabilites de l'assurance sont les suivants.

a) Developpement du systeme d'assurance afin d'assurer le niveau de l'assurance publique pour tous les citoyens, en donnant la priorite aux assurances d'emploi et de travail.

b) Coherence et concertation parmi les divers secteurs de l'assurance sociale et medicale.

c) Application du plan de l'assurance obligatoire des salaries. d) Creation des fonds d'assurance necessaires comme

l'assurance des arts et métiers (les assures volontaires et les intennittents), l'assurance pour les villageois et les tribus nomades, l'assurance speciale des veuves et des femmes Ages ou delaissees et l'assurance speciale des enfants.

e) Developpement des assurances de dommages pour des fleaux naturels tels que inondation, la secheresse, le tremblement de terre ou la tempote.

0 Soutien juridique aux assurances complementaires. g) Supervision des activites des fonds d'assurance. h) Reforme des statuts des compagnies et des fonds d'assurance

de sorte que le principe d'entreprise soit observe pour ces compagnies et fonds d' assurance.

Remarque 3 — Les ressortissants des pays &rangers, residant en Republique islamique d'Iran, beneficieront des protections definies dans le systeme global de la securite sociale, dans le cadre des principes islamiques, les accords et les conventions internationales, A condition de la reciprocite.

Article 2 A)Assurance: Les services des assurances sociales et modicales

se divisent dans deux categories «publique» et complementaire»: 1-La loi determine les Hittite des services des assurances

publiques. 2-Les assurances complementaires sont des services d'assurance

qui, outre le niveau des services d'assurances publiques, s'etablissent par la conclusion des contrats individuels ou collectifs entre l'assureur et l' assure, ce demier payant les frais de ce contrat, sans que le gouvemement ait tin quelconque engagement financier dans ce domaine, tout en &ant responsable d'assurer le soutien legal et juridique a ces services d'assurance.

CHAPITRE PREMIER

Objectives, Scope and Responsibilities

Article premier — En vertu de l'article 29 et les clauses 2 et 4 de l'article 21 de la Constitution de la Republique islamique d'Iran, et pour creer la coherence necessaire et globale dans la politique portant stir le bien-etre social en tant que moyens permettant la promotion de la justice sociale, et enfin pour proteger tous les citoyens devant les evenements sociaux, econoiniques et naturels, ainsi que leurs consequences, le systeme global de la securite sociale est etabli selon les reglements et le contenu de cette loi, pour les affaires suivantes:

a) retraite, incapacite permanente et daces b) chernage c) vieillesse d) &route, delaissement et traumatismes sociales e) incidents et accidents f) incapacites physiques et morales g) assurance des services hygieniques et medicaux h) protection des meres, surtout pendant la grossesse et la garde

Lors de la séance publique du mardi 28 octobre 2003, l'Assemblee islamique d'Iran a vote «urgence (Wart* du projet de loi numero 22559 du 7 at& 2002, presente par le gouvernement, portant sur la structuration glob ale du systeme de la securite sociale du pays. Lors de la séance publique de l'Assemblee, le lundi 10 mai 2004, ce projet de loi a ete raffle par l'Assemblee islamique, avec certains changements dans le titre et darts le corps du texte, et il a 6[6 approuve ensuite par le Conseil des gardiens de la Constitution.

public executive organizations, funds and institutions active in insurance protection and relief sectors of the system will be withdrawn from the relevant ministers or their highest authority, and conferred upon the Minister of Welfare and Social Security. This transfer also includes membership in councils, assemblies or board of trustees of the social institutions, principal and subsidiary government commissions, cross-sectional high councils and relevant international bodies.

Article 18- Enactment of this law in relation to the Imam Khomeini Relief Committee and Armed Forces affairs depends on consent of the Supreme Leader.

Article 19- From the date of the Approval of this law, those sections of social security, medical insurance services, protection and relief regulations contradicting these laws are null and void.

Clause - If and when there is need for the establishment, individually or collectively, of a special fund for employees of one or a number of executive bodies, two most high-ranking officials of that establishment or establishments will as observers attend meetings of the council, assembly, or broad of trustees.

B. Board of directors: consists of five or seven people with diverse expertise and experience to be appointed for four years by the council, assembly or the board of trustees on duty basis (without accepting executive responsibility). Their re-appointment is allowed, and they will elect one person from among themselves as chairman of the board.

C. General Manager: an individual from outside the general assembly and board of directors will be appointed as general manager for four years upon the proposal of the board of directors, approval of the council, assembly, or the board of trustees. Re-election is permissible.

D. Supervisory Board: consisting of three individuals with necessary expertise and experience to be elected for four years by the council, assembly or board of trustees, and their re-election is permissible (duty of legal inspections is the function of the State Auditing Organization, which will submit its report to the Supervisory Board for review and assessment).

Clause I - Minimum qualification for membership in each one of the above-mentioned institutions is a post-graduate degree and five years of specialized experience in management, accounting, insurance, finance, economics, informatics and medical groups. Appointments will be substantiated after approval of their qualifications for the posts by the state Management and Planning Organization.

Clause — Organizing specialized and strategic councils in the three domains of the Comprehensive Social Security System will be according to a by-law approved by the Cabinet.

Article 17- The Ministry of Welfare and Social Security is obliged, within one year from the approval of this law, to review and amend the statutes of all executive bodies, institutions, government and public funds active in the insurance, protection and relief sectors (within the framework of the comprehensive relief and rescue program) whose inclusion to the law requires mention of their name, and after approval by the Supreme Council submit them for ratification by the Cabinet. Using public funds for newly approved organizations, funds and entities are authorized. Amendment of statutes related to the foundations of the above-mentioned institutions should be in a manner that heir overall composition is as follows:

A. Council, assembly of board of trustees with following conditions:

1. Half the members plus one will be appointed on the proposal by the Minister of Welfare and Social Security, to be confirmed by the Supreme Council of Welfare and Social Security and ratified by the Cabinet.

2. Remaining members, in proportion to the number of people under the coverage of the "established and organized service receivers", will be appointed in accordance with a by-law to be approved by the Cabinet. In the absence of such official establishments and till the date of their formation, the remaining members will be appointed as per the proposal of the Minister of Welfare and Social Security, approval of the Supreme Council of Welfare and Social Security, and Cabinet ratification.

and proposing it to the Supreme Council of Welfare and Social Security.

G. Management of resources and expenditures, and drafting the combined budget of the Comprehensive Social Security System aimed at balancing the funds and efficient allocation of resources for diverse sectors of social security system.

H. Organizing supervisory and evaluation mechanisms of the performance of the Comprehensive Social Security System, and presenting relevant reports to the Supreme Council of Welfare and Social Security.

I. Regulation and executive management of target-oriented social subsidy programs, and directing the same towards needy individuals and households in accordance with self-sustaining and employment approach within the framework of law and general policies of the government.

J. Planning and regulating the performance of the system in a manner that every individual, the needy in particular, have the best possible access to benefits of social security and protection through insurance networks.

K. Regular review and evaluation aimed at assuring the financial stability (resources and expenses) of operational sectors of the system for meeting current and future commitments and submitting reports to relevant authorities.

L. Preparing grounds for broader presence and participation of charities, endowments and civil institutions in protection and relief sectors of the Comprehensive Social Security System.

M. Establishing the Comprehensive Social Security System data bank for gathering and processing information, and determining relevant indices for insurance, protection and relief sectors.

N. Conducting applied research.

meetings, quorum for decision-making and other issues related to the Supreme Council of Welfare and Social Security will be prepared by the Ministry of Welfare and Social Security and

ratified by the Cabinet.

Article 16 - To accomplish the objectivesand fulfill duties stipulated in Chapter I and implement Principles and policies enshrined in Chapter II of this law, the authority Ministry of Welfare and Social Security are defined follows:

A. Preparing grounds for enforcing principles governing comprehensiveness and effectiveness of the system, and expansion of insurance, protection and relief cover in the country (within the framework of the comprehensive rescue and relief program).

B. Coordination and interaction of the Comprehensive Social Security System programs and their counterparts in the employment, health and medical care, education, housing and other

relevant sectors. C. Drafting policies, strategies and criteria for the

comprehensiveness and effectiveness of the Comprehensive Social Security System within the context of law and general policies of the government for approval by the Supreme Council and Cabinet

ratification. D. Coordinating executive plans of the three areas of

Comprehensive Social Security System. E. Preparing drafts, bylaws and guidelines to achieve objectives

and policies of the Comprehensive Social Security System, and proposing the same to the relevant authorities for approval.

F. Drafting the government's macro public budget for social security, medical insurance services, support and relief schemes,

Article 15 - Responsibilities of the Supreme Council of Welfare and Social Security:

A. Coordinating social policies. B. Interaction with the Economic Council and other cross-

sectional councils for resolving social problems. C. Review, amendment and approval of welfare and social

security policies and its proposal to the Cabinet in concord with government macro policies.

D. Review, amendment and approval of the annual welfare and social security budget within the framework of country's general and budgetary policies and its proposal to the Cabinet.

E. Recommending general rules for management of capital, deposits and investments by the executive, government and public bodies, institutions and funds involved in various areas of the social security system upon approval of the government.

Clause 2 - Given the inherent nature of insurance affairs, all institutional and organizational titles of bodies active in the social and medical insurance fields will be changed to "funds".

Clause 3 - All institutions covering families of martyrs, POWs, missing in action, war disabled, former POWs, and veterans of the Islamic Revolution and Iraq-Iran War, based on the letter of Feb. 6, 2003 from the Supreme Leader Ayatollah All Khamenei to President Mohammad Khatami will be merged into one organization. Upon approval of the Leader, all holdings, assets and resources of the Martyrs Foundation, Headquarters for Ex-POW Affairs, and 50 percent of assets, properties and resources of the Mostazafan and Janbazan Foundation will be transferred to the newly established organization. Incomes generated by the above assets and ownership will be allocated exclusively to the affairs of martyrs and veterans within the framework of social security system.

Article 13 - Supreme Council of Welfare and Social Security: in order to coordinate social policies in the areas of social security, employment, physical education, housing, health, Medicare and all other sectors related to social security, the Supreme Council of Welfare and Social Security headed by the President of the Islamic Republic of Iran with the Minister of Welfare and Social Security as its Secretary, is being established in the Ministry of Welfare and Social Security. Decisions by the Supreme Council will be valid upon endorsement by the President and ministers sitting on the council.

merger of the two existing ministries before the end of the Third

Economic, Social and Cultural Development Plan.

Article 12 - Four principle bodies of the Comprehensive Social Security System:

1. Supreme Council of Welfare and Social Security. 2. Ministry of Welfare and Social Security. 3. Main institutions and funds in each area of social insurance,

medical insurance, services, protection and relief affairs responsible for regulating resources of this system, including public resources and subsidies allocated by ministries, resources acquired through participation of social partners or exercising executive tasks in various areas of social insurance, medical insurance services, protective affairs and relief activities on behalf of the government.

4. Executive institutions including commercial insurance companies, municipalities, rural administrative bodies and other structural entities consisting banks, funds, welfare and service companies, charities and civil bodies that will function as executive agencies of the Comprehensive Social Security System in the framework of agreements and memorandums of understanding.

Clause 1 - Establishments, organizations, institutions and the main funds active in the insurance, protection and relief areas of this system are obliged to transfer the executive and administrative activities related to their production and provision of services and relevant legal obligations to executive agencies through contracts the terms and conditions of which will be determined upon proposals by the ministry to be approved by the Supreme Council of Welfare and Social Security.

Chapter Three

Organization

Security System.

Article 11- The Ministry of Welfare and Social Security is being established in line with realization of the Comprehensive Social Security System and implementation of this law.

Clause 1 - Any use of resources of the social security system, whether public or subsidies, in areas of insurance, protection or relief by government and executive departments, non-government funds and bodies outside the scope of this system and under any title and purpose is banned. Any access to such resources is subject to the supervision and overall guidance of the Ministry of Welfare and Social Security.

Clause 2 - Policies of the Ministry of Health covering health, medication, classification of medical services and system of referral are mandatory for the Ministry of Welfare and Social Security and its affiliated bodies.

the national code project and tax regime, in a manner that subsidies for high-income households are reduced or eliminated, and those for the low-income groups increase. Resources made available by eliminating or reducing subsidies for the higher brackets will be used for complementing the resources of the Comprehensive Social

them to meet their own needs, and implies that provision of welfare services is subject to fulfillment of specific commitments.

G. Policy of active identification of the needy helping protect the rights of people through a comprehensive data collection system, upholding human dignity, and negating indignity.

H. Government will guarantee the rights of members and those under insurance coverage against the legal commitments of insurance organizations, institutions and funds of this system. The government is obliged to take necessary financial, monetary and structural measure in this respect.

I. Provision of insurance undertaking by funds towards members and insured individuals will be on the basis of justice and in proportion to the level of participation (membership and amount of premium), and by adjusting inputs and outputs in accordance with insurance-related assessments.

J. Organizations, institutions and insurance funds of the social security system have natural commitments, and rights of the insured in relation to the funds is exclusive to receiving legal commitments

Cause: Given the limits of government resources in all three policies (adequacy, comprehensiveness and broad-based), the government is obliged to include its relevant progression policies in the country's development plans.

Subsidy Principles and Policies

Article 10 - Subsidy policies will be determined within the framework of law and in accordance with the general policies of government aimed at creating targeted subsidy programs by drawing on the country's comprehensive data system, including

of the people, and prevent any shock and impact thereof, the authority in charge of the Comprehensive Social Security System will participate in economic decision-making, particularly those related to determining minimum wages. He will also attend, with a right to vote, meetings of the Economic Council, High Labor Council, Money and Credit Council, High Medical and Social Insurance Council, High Health Council, and the High Family Council.

Article 9 - Principles and Executive Policies of the Comprehensive Social Security System

A. Comprehensive policy: comprehensive means providing variety of services stipulated in this law.

B. Adequate policy: based on this policy, in the first phase the basic needs of all members of the society will be provided. Quantity and quality of services will be enhanced in the second phase.

C. Broad-Based Policy: services of social security system must be made available and guaranteed to the entire population.

D. Preventive policy: implementation of this policy covers all three areas of insurance, protection and relief. Based on this policy, emphasis is on the need for coordination with other effective institutions in a manner that efforts aimed at preventing the emergence of, or increase in social ills becomes the basis of a cross-sectional coordinated policy.

E. Empowerment policy: empowerment means reducing methods of direct provision of needs with reciprocal increase in individual or collective abilities of dependent individuals to meet their own needs.

F. Job creation policy: the job creation policy is a non-protective mechanism. Facilitating job opportunities for individuals enables

enable the insurance, support and relief sectors meet the needs of the citizens in a sustainable manner.

B. Financial supervision over resources: All departments, organizations, institutions and funds working

in areas of insurance protection and relief activities in proportion to their accessibility of resources and facilities in social security system will be subject to government supervision within the framework of this law.

C. Implementation of government decisions and decrees concerning reduction in resources and/or increasing expenditures and commitments of insurance funds and institutions, will depend on provision of equivalent financial resources. Revoking the ruling of this article depends on specifying name and indication of the subject in other laws.

D. Funds, properties, deposits and assets of social and medical insurance funds are considered as public property, subject to joint ownership, and belong to all generations of the society under insurance coverage. Any takeover of such properties by the government, and financial relations of the government with the said funds will be based on rules and regulations governing the activities of the funds.

E. Amounts owed by the govenunent to organizations, funds and insurance institutions active in areas of the social security system will be paid on the basis of the current value and rate of bonds.

Article 7 - Financial Principles and Policies of the Comprehensive

Social Security System: A. Sustainability of financial resources include:

1. Access to public resources. 2. Resources made available through target-oriented subsides.

3. Balancing resources and expenses of insurance funds while maintaining the legal status and fmancial independence of the funds.

4. Providing resources for the insurance sector with the participation of employer, insured and government.

5. Resources allocated for social compensation of damages caused by economic and development policies.

6. Making use of public contributions in spheres of the social

security system. 7. Utilizing financial resources secured though endowments in

sphere of the social security system.

8. Making use of resources from religious tax (Khoms) and alms (Zakat) and other faith-based donations in spheres of the system and authorized by religious authorities.

9. Making use of alms and charity.

10. Making use of resources, properties and assets of institutions and foundations of the Islamic Revolution in various areas of the social security system and with the permission of the Supreme

Leader. 11. Incomes generated through investments, management of

capital and reserves belonging to government and public executive departments, organizations, institutions, and funds active in various domains of the social security system.

criteria specified in their statute, contracts and agreements. I. Competitiveness: enforcing the principle of competitiveness

at the executive level of the system aimed at expanding the competitive environment and promoting the following benefits:

1. All insurance levels of social security system to be planned and regulated in a manner that underpins competition.

2. The insure policyholder is able to choose the insurer institution.

3. To ensure a healthy competitive environment and prevent the monopoly or semi-monopoly, and based on the relevant law, the government is authorized to invoke controls and anti-monopoly measures.

J. Financial participation: I. Access to funds active in public social and medical insurance,

for each member from public resources on per capita basis, would be equal. This will not prevent the government from supporting the needy.

2. Percentage of participation and insurance premium share of the employer, based on deduction of premium in funds active in the public social and medical insurance sectors, would be alike.

3. Percentage of participation and insurance premium share of the insured, based on deduction of premium in funds active in public social and medical insurance sectors, would be alike.

K. Transfers: transferring the insured from one public insurance fund to another, individually or collectively, would be possible on the basis of a by-law approved by the Council of Ministers (Cabinet).

L. Organizations, institutions and funds active in the insurance sector of the system have legal status and financial and administrative independence, and function in accordance to their

This participation does not mitigate the government of its responsibilities, and at all times the government is responsible to provide social security.

E. Voluntary public assistance to secure the financial resources by non-governmental and public institutions, organizations and companies of social security system is authorized provided it is extended on the basis of a by-law approved by the Council of Ministers (Cabinet) and supervision by the social security system

is possible. F. Improvement: improvement of activities are based on

following three policies: * specialization of activities based on the type of services

* specialization of activities based on the receivers of services

* specialization of activities based on the level of services (general or complementary)

G. Centralization and Decentralization: this principle emphasizes the following policies:

1. Planning, policymaking, supervising, evaluating and distribution of public resources in a centralized manner and by the

government. 2. Executive affairs are decentralized.

3. Intervention by the government at the level of social security executive functions is permissible and necessary if and when the scale of activities by non-government institutions is inadequate to provide the required services, and/or for regulating the market for social security services, or compensating market deficiency.

4. Considering local conditions in planning. H. Supervising both government and non-governmental sectors

relevant to the Comprehensive Social Security System. Such supervision will be on the basis of and in accordance with this law,

Principles and General Policies

Article 6- Principles and Structural Policies of the Comprehensive Social Security System:

A. Intra-Sectoral Coordination: streamlining and coordinating operations and services provided by various insurance, support and relief sectors aimed at promoting effectiveness and broader coverage of the activities of various departments to prevent overlapping and interference in their activities.

B. Inter-Sectoral Coordination: coordination among insurance, protection and relief sectors will be carried out with respect to the centrality of insurance system.

C. Coordination between preventive and executive activities of sectors affecting social security.

D. Participation of non-governmental sector: the social security system is based on the principle of participation in policymaking, planning and evaluation, in a manner that non-governmental bodies, based on the defined methods, can participate. Such participation includes organized and established service receivers such as non-governmental organizations and institutions.

cooperation with government non-governmental organizations and

civil entities. Clause — The Iranian Red Crescent Society is a non-govenunent

institution, which functions in accordance with its statutes ratified

by Parliament.

unable to work due to physical and mental reasons. E Extending loans for a fixed period to individuals in search of

employment. G. Coverage of households without a bread earner and self-

supporting women. H. Facilitating rehabilitation, training and working skills for

needy households. I. Supporting mothers especially during pregnancy and child

fostering. J. Providing services to prevent occurrence or exacerbation of

disabilities and social vulnerabilities in target groups, and providing coverage for them in three levels of prevention, treatment and

rehabilitation. K. Providing facilities for improvement of the physical, mental,

social and economic conditions of the disabled for continuing their life and making efforts to maintain the independence and self-sufficiency of the disabled, people deprived of equal social opportunities and the socially disadvantaged.

L. Preparing the social and physical environment conducive to the characteristics and abilities of the disabled.

M. Continued support for the poor in rural areas and tribesmen.

Article 5 - Objectives and Responsibilities of the Relief Sector: A. Preparation of and coordination among relevant

organizations for delivering urgent and adequate assistance to those who have suffered from unforeseen disasters and providing basic needs such as food, clothing, temporary shelter for victims of natural disasters within the framework of the country's rescue and relief plans.

into consideration for insurance companies and funds. J. Supervising the balance between resources and costs of the

funds based on insurance auditing. K. Information dissemination about insurance services.

Clause 1 - Every insurance fund can participate in one of the two fields of social and medical activities, or in both.

Clause 2 - The government is obliged to prepare the grounds for insurance coverage of all sectors of society, including the rural population, tribesmen and seasonal workers within two years from the notification date of this law.

Clause 3 - Earlier commitments of insurance organizations and funds towards the insured remain valid provided they are under the insurance coverage of only one organization or fund, and the additional commitments will be met by this system if and when necessary funds are made available.

Article 4 - Objectives and Responsibilities of the Protection and Rehabilitation Sector

A. Organizing and target-orienting subsidies and protection resources.

B. Coordination of various government sectors aimed at preventing social vulnerabilities.

C. Partaking in defining the poverty line (absolute and relative) D. Protecting members of the society against economic and

social disruptions and their undesirable consequences, especially in cases of unemployment, loss of bread earner, the helpless, and old age.

E. Providing the minimum of basic needs for all individuals and households lacking adequate income by prioritizing those

legal and lawful support for such insurance schemes. B. Support and rehabilitation sector: including provision of

supportive and rehabilitation assistance, and allocating subsidies and financial support to individuals and needy households that due to various reasons are unable to work, or their income is not sufficient to sustain the minimum standard of living.

C. Relief sector: including rescue and relief during unpredictable disasters.

Article 3 - Aims and responsibilities of the insurance sector: A. Expansion of insurance coverage and providing public level

insurance to every member of the society by giving priority to insurance based on the labor market and employment.

B. Coordinating and consolidating various sections of social and medical insurance.

C. Implementing mandatory insurance schemes for wage earners.

D. Establishment of necessary E. Establishing the required insurance funds such as private

professional and occupational insurance (self-employed and periodical jobs) villagers and tribesmen insurance, special insurance for divorcees, elderly and self-supporting women, and children.

F. Expansion of special insurance for compensation of damages caused by the natural disasters including floods, draught, earthquake and storm.

J. Special insurance schemes for divorcees, old, and self-supporting women K. Reducing inequality and poverty L. Rescue and relief

Clause 1- Access to social security in a manner stipulated in this Act is a right guaranteed to all citizens of the country and its provision is the duty of the government

Clause 2- Possible negative impacts and consequences emanating from acts of govemment are considered examples of socio-economic events.

Clause 3- Foreign nationals residing in the Islamic Republic of Iran, within the framework of Islamic norms, international conventions and agreements, and on the condition of reciprocity will be subject to support provided by the Comprehensive Social Security System.

Article 2 - The social security system includes three sectors: A. Insurance sector: including social insurance such as

retirement, unemployment, accidents and events, disability and survivors, and medical insurance section (health and treatment).

Clause - Social and medical insurance services are categorized into public and complementary phases in a manner that:

1. Scope of the public insurance services is defined by law. 2. Complementary insurance is referred to those categories of

insurance services that are provided in addition to the extent of public insurance services, based on individual or collective agreement concluded between the insured and insurer and payment of insurance premium by the insured. The government will not have any financial commitment toward it, but is obliged to provide

_ Objectives, Scope and Responsibilities

Article 1 - In implementation of Article (29) of the Constitution of Islamic Republic of Iran, as well as clauses (2) and (4) of Article (21) of the Constitution, and in line with consolidation of the macro welfare policies aimed at promoting social justice and supporting all citizens of the country vis-a-vis social, economic and natural events and their consequences, the Comprehensive Social Security System based on the terms and conditions of this Act has been established. It will cover the following: A. Retirement, disability and death B. Unemployment C. Old age D. Helplessness, loss of caretaker and social vulnerabilities

E. Accidents and incidents F. Physical, intellectual and mental disabilities

G. Health, medication and Medicare insurance services

H. Supporting mothers, particularly during pregnancy and child

6. The assets and capital of the funds are considered as public property and belong to all generations under insurance coverage and the relationship of the government and the funds are based on the framework of the governing laws and regulations of the funds.

7. The pending payments of the government to the insurance funds should be paid on the basis of their current value and in accordance with the rate of the bonds.

service receivers. Fifth level: consisting of broker institutions which include

commercial insurance companies, municipalities, rural administrative bodies, banks, service providing companies and institutions and civil and charitable establishments and soon.

The main administrative departments of the comprehensive system are duty bound to an extent that is possible to transfer the administrative responsibilities to broker institution through contracts and agreements that their terms and conditions are approved the Supreme Welfare and social security Council.

In this level, one of the main objectives of the law has been promotion and expansion of public participation and institutionalization of the activities.

The law includes some main and important rulings such as: 1. The insurance sector is the focus of the comprehensive welfare

and social security system and the protection sector for coverage of the cases excluded in insurance sector.

2. Undertakings of insurance funds on the basic and public level are guaranteed by the government.

3. Te share of active funds from the public resources on the level of social security and medical treatment for each individual would be equal in per capita basis but this would not prevent the government from supporting the vulnerable sectors of population.

4. The percentage of participation and the share of employer and the insured in the funds would be equal in proportion to the wage.

5. Implementing governmental decisions and instructions leading to reduction of resources or increasing the expenditures and commitments of the funds and insurance institutions depend upon provision of the financial resources.

coordination among social sector affairs with other sectors: For this purpose establishment of the Supreme Council of Welfare and Social Security under the chairmanship of the President of the Islamic Republic of Iran has been planned.

Second level: governmental affairs such as planning, allocation of resources, supervision and evaluation, formulation of instructions and rules, determining the indexes and standards and establishment of comprehensive information system:

To achieve the above objectives, Ministry of Welfare and Social Security has been established as the second pillar of the comprehensive system.

Third level: sector for consolidation and macro coordination among various organizations within each sector at level of jurisdiction and operation: For this purpose, establishment and regulation of specialized strategic councils in various insurance, supporting and relief sector has been anticipated. These councils are responsible for coordination and consultation among the various elements and parts of each sector of comprehensive system such as allocation of resources and funds between different. departments, establishment of inter-departmental coherence and so on.

Fourth level: the executive sector of the comprehensive system that based on the decentralization principle consists of main institutions and organizations in the three sectors of the comprehensive system.

The said institutions while maintaining their legal status and administrative and financial independence would function under the supervision of the Ministry of Welfare and Social Security.

these organizations and extensive overlapping and interference of their responsibilities; inadequacy and insufficiency of welfare and social security services; various scattered and some how uncoordinated and inconsistent organizations working in insurance fields (social and medical), supportive and relief works; lack of coherent framework for macro and strategic policy making at the national level; lack of some key institutions for forging organizational coherence within the various activities of the country's social security system; lack of some executive establishment to cover certain portion of country's population specially in rural areas; lack of an efficient, reliable, comprehensive and up to date information system needed for decision making, implementation, supervision and evaluation; weakness of country's subsidizing system in meeting the needs of implementation of efficient schemes, redistribution policies and scientific, economic and social considerations governing these issues were the main and most important problems that the comprehensive system Act was approved to tackle them.

Based on the said law, Iran's welfare and social security system consists of three main sectors:

Insurance sector (including social and medical insurances in two levels of basic and complementary).

Supporting and rehabilitation sector. Relief sector (relief and rescue in unpredictable events) . One of the main principles of the social law is coordination

among these three sectors with insurance sector playing the central role.

Levels of jurisdiction-administration of the comprehensive system based on the above mentioned law are as follow:

Introduction Due the importance of the concept of welfare in modem Political

systems, formulating the comprehensive welfare Policies have become of a vital and sensitive undertaking. Because of such importance, the welfare policy making in itself form the core of the programs of governments in general and the democratic governments in particular.

Article 29 of the Constitution of the Islamic Republic of Iran stipulates the right of all citizens to be covered by social security and has demanded the government to secure this right either individually or public participation.

The comprehensive welfare and social security system Act which is adopted based on the Article 29 and clause 2 and 4of Article21 of the Constitution and is aimed at consolidating the welfare policies and promotion of social justice is so important that it could be termed as a new Social Contract in Iranian society.
