Conveno da Diversidade Biolgica marco conceitual e alcance (1992)

Um dos mais significativos avanos da Conveno sobre Diversidade Biolgica o reconhecimento do conhecimento tradicional de comunidades locais e povos indgenas como fundamental para a conservao e para o uso racional da biodiversidade

One of the most significant advances of the Convention on Biological Diversity is the recognition of traditional knowledge of local communities and indigenous peoples as essential for the conservation and rational use of biodiversity

Desse reconhecimento, se derivaram importantes direitos a esses povos e comunidades, sendo os principais:

(i) o consentimento prvio informado para o acesso ao conhecimento tradicional associado aos recursos genticos e

(ii) a repartio justa e equitativa dos benefcios advindos da utilizao de recursos genticos e do conhecimento tradicional a eles associados

This recognition, derive important rights of these peoples and communities, being the main ones:
(i) prior informed consent for access to traditional knowledge associated with genetic resources and (ii) the fair and equitable sharing of benefits arising from the utilization of genetic resources and traditional knowledge associated with them

Tais direitos encontram-se ameaados em razo do Projeto de Lei (PL)7.735/2014, tramitando em regime de urgncia na Cmara dos Deputados, que visa substituir a Medida Provisria 2.186-16/2001.Such rights are threatened because of Bill (PL) 7735/2014 being processed on an emergency basis in the House of Representatives, to replace the Provisional Measure 2186-16 / 2001

Povos indgenas e comunidades locais, detentores do conhecimento tradicional associado aos recursos genticos, foram excludos do processo de elaborao do referido PL e sequer foram consultados sobre seu contedo.

Indigenous peoples and local communities, holders of traditional knowledge associated with genetic resources, were excluded from the said PL-making process and were even consulted about its contents

Por outro lado, a elaborao do PL, oriundo do Poder Executivo, contou com intensa participao dos setores empresariais envolvidos, o que garantiu a consolidao de seus interesses privados, como a dispensa de qualquer autorizao para o acesso a recurso gentico e conhecimento tradicional associado, a anistia geral e irrestrita a todas as penalidades impostas por suas irregularidades e a dispensa de pagamento de repartio de benefcios em diversas hipteses.On the other hand, the development of PL, coming from the executive branch, had intense participation of the involved business sectors, ensuring the consolidation of their private interests, such as waiver of any authorization for access to genetic resources and associated traditional knowledge, the general and unrestricted amnesty to all penalties imposed by its irregularities and benefit sharing for remission on different assumptions

Direitos j consagrados na legislao brasileira, como o consentimento prvio informado e a repartio de benefcios derivada do uso dos recursos genticos e do conhecimento tradicional associado, se apresentam de forma desfigurada no PL, sendo objeto de grandes limitaes

Rights already enshrined in the Brazilian legislation, such as prior informed consent and benefit sharing derived from the use of genetic resources and associated traditional knowledge, are presented in a distorted way in PL, the subject of major limitations

O processo de consentimento prvio informado, por exemplo, pressupe que seja possvel no consentir, ou seja, dizer no ao acesso e ao uso do conhecimento tradicional. No PL, essa possibilidade no existe

The prior informed consent process, for example, assumes that you can not consent, that is, say 'no' to the access and use of traditional knowledge. In PL, this possibility does not exist.

A repartio dos benefcios advindos do acesso aos recursos genticos e ao conhecimento tradicional, por sua vez, deixa de ser justa e equitativa no PL, para ser injusta e insignificante

The sharing of benefits arising from access to genetic resources and traditional knowledge, in turn, ceases to be fair and equitable in PL, to be unjust and insignificant

Consideraes finais

1) fundamental que os detentores do conhecimento tradicional associado ao patrimnio gentico se mobilizem e se envolvam nesse debate, sob o risco de se permitir a consolidao de limitaes aos seus direitos;2) dados indicam 522 etnias no territrio nacional e ocupam 25% do territrio;3) o retrocesso ambiental expresso e precisa ser combatido;4) Marco Legal da Biodiversidade: Patrimnio, Direitos e no simplesmente Mercadoria.

Final considerations

1) fundamental as the holders of traditional knowledge associated with genetic resources are mobilized and get involved in this debate, at the risk of allowing the consolidation of limitations to their rights;
2) data indicate 522 ethnic groups in the country and occupy 25% of the territory;
3) the environmental kicker is expressed and must be combated;
4) Biodiversity Legal system: Heritage, Rights and not simply Merchandise
