RESUMO
O objecto de estudo da presente dissertao a inspeco tributria, em sentido lato, entendida quer
enquanto poder legitimado constitucionalmente com vista prossecuo do interesse pblico da justia
e igualdade fiscal, quer enquanto procedimento, ou seja, enquanto conjunto de actos destinado
comprovao concreta das realidades tributrias, em cumprimento de tal desiderato constitucional.
Porm, para se compreender o procedimento necessrio primeiro compreender o fenmeno da
inspeco enquanto poder, pelo que a metodologia utilizada passa por em primeiro lugar proceder ao
enquadramento da inspeco nessa dimenso, caracterizando-a, orgnica e historicamente, bem como
identificando os meios que este poder tem ao seu dispor para materialzar e concretizar o fim a que se
destina. S atravs deste prvio enquadramento ser ento possvel perceber e apreender o
procedimento tributrio de inspeco e todas as suas vicissitudes enquanto instrumento concretizador
do poder inspectivo.
Como iremos observar ao longo do presente estudo a inspeco tributria, em qualquer destas
dimenses, quer enquanto poder, quer enquanto procedimento, pode, apesar de legitimada
constitucionalmente, colidir com outros direitos, liberdades e garantias, tambm estes com
acolhimento constitucional.
certo que o interesse pblico subjacente inspeco tributria de justia e igualdade fiscal pode
prevalecer sobre esses direitos, liberdades e garantias, impondo o seu sacrifcio aos particulares.
Porm no os pode sacrificar a todo o custo, em todas as situaes e circunstncias. Este sacrficio
deve ser sempre minimizado ao mximo, ou seja, o sacrifcio imposto aos contribuintes deve ser
exigvel, adequado e proporcional. Assim, tais direitos, liberdades e garantias constituem limites
formais e materiais essenciais que devem nortear e balizar a prtica de actos de inspeco. A violao
de tais direitos, liberdades e garantias, para alm das consequncias invalidantes do prprio acto
tributrio resultante do procedimento (violao dos limites formais), sempre que ultrapasse o limite do
razovel (violao dos limites materiais ou seja dos direitos fundamentias), no pode ter outra
consequncia que no a responsabilizao civil da Administrao fiscal e dos agentes da inspeco,
bem como a responsabilidade penal destes ltimos (sem prejuzo da responsabilidade disciplinar
igualmente imputvel, mas que no tem eficcia sobre a esfera jurdica dos contribuintes).

ABSTRACT
The object and purpose of the present study is the tax inspection, in a large sense, seen not only as
constitutionally legitimated power, guided to fulfill de public interest of justice and tax equality, but also
as an administrative procedure, seen as a set of acts with the main objective of checking and certifying
that the tax reality is in compliance with the constitutional command.
But, to fully comprehend the procedure we must first understand the tax inspection phenomenon as a
power, so the methodology used in this study requires in first place to fit in the inspection in that
dimension, characterizing it historically and organically and identifying the means that this power has at
his disposal to fulfill the purpose of its creation. Only through this previous characterization we will be
able to fully comprehend the tax inspection procedure as an instrument of the power to inspect.
As we will see throughout the present study the tax inspection, in any of its dimensions, while power,
or while proceeding, may, although constitutionally legitimated, collide with other fundamental rights,
freedoms and guaranties, which are also constitutionally legitimated.
It is certain that the public interest behind the tax inspection justice and tax equality may prevail
over those rights, freedoms and guaranties, imposing their sacrifice to all individuals. But, that sacrifice
cannot occur at any cost, in all circumstances. That sacrifice must be always minimized, by being
demanded, adequate and proportional. So, those rights, freedoms and guaranties, are important formal
and material limits that must guide and limit the tax inspection activity. Their violation, beyond the
invalidity consequences of the administrative act that results from the procedure (violation of formal
limits), when exceeds beyond reason (violation of material limits) cannot have other consequence than
the civil responsabilization of the tax authorities and its agents, as well as the criminal
responsabilization of the tax inspectors (without prejudice of the disciplinary responsability applicable,
but that doesnt affect the tax payer whose rights where violated).
